The State Duma: Law obliging investigation authorities to return confiscated electronic media to their owners is adopted
The State Duma has adopted in the third, final reading the law, requiring the investigation authorities to return electronic media confiscated in the course of the investigation to their owners. Appropriate amendments are introduced in the code of criminal procedure of the Russian Federation.
According to the adopted law, the electronic media, seized during the pre-trial proceedings, but not recognized as material evidence, after the completion of the investigative actions should be returned to their legal owners in the term corresponding to the requirements of reasonable periods of the implementation of the criminal proceedings.
At the same time, in those cases, when the withdrawal of the electronic media is necessary to prove, in order to avoid difficulties of a business entity contained on the media information can be copied on the request of their legal owner.
According to authors of the document, its implementation will provide an additional protection of the rights of entrepreneurs and solve the problem of the continuation of the activities of economic entities in case of withdrawal of electronic media in the course of the investigation of criminal cases.
