Председатель ВЦИК Я. М. Свердлов, открывший заседание 5 (18) января 1918 г., предложил делегатам принять написанный В. И. Лениным проект «Декларации». Однако Собрание большинством голосов отказалось даже ее обсуждать. В итоге, «Декларация» была утверждена 18 (31) января 1918 г. на объединенном III Съезде Советов и вошла в Конституцию РСФСР 1918 г. в качестве вводного раздела.
